Severance Agreements
Texas Local Government Code Section 180.011(d) requires certain political subdivisions to make executive employee severance agreement information available to the public
City Manager Severance Upon Termination “Without Cause.”
In the event the employment of the City Manager is terminated by the City Council of the City of Brenham “without cause,” the City Manager will be entitled to receive a lump sum payment equal to 20 weeks of the then-current base salary, less applicable payroll deductions. The City Manager will also be entitled to the dollar equivalent of the City Manager Vacation Pay, less applicable payroll deductions. Further, the City will be responsible for paying the City Manager’s COBRA health insurance premiums for her and her family for a period of six (6) months following termination.
In the event City Manager’s employment is terminated “without cause,” in consideration for the agreement of the City of Brenham to make the payments described herein, the City Manager agrees to sign a mutual waiver and release of any claims against the City of Brenham arising out of or relating to the employment or the termination thereof. By accepting the severance payments described herein, City Manager does and will waive and release any claims against the City of Brenham arising out of or relating to employment or the termination thereof and will execute an instrument to that effect. The payment of the severance payments described herein will be made to City Manager within thirty (30) calendar days of any such termination and the effective date of the mutual waiver and release agreement.
