Public Hearing on the Adoption of Impact Fees Scheduled for February 1, 2024

The City of Brenham City Council will hold a public hearing at the Council Chamber at City Hall, located at 200 W Vulcan, Brenham, Texas 77833 on Thursday, February 1, 2024, at 1:00 p.m. The hearing is to consider the adoption of an Impact Fee for water, wastewater, and roadway capital improvements and facility expansions necessitated and attributable to new development.

Impact Fees are charges or assessments a City imposes on developers to generate revenue to fund or recoup costs of capital improvements or facility expansions associated with new development. The Texas Local Government Code, Chapter 395 governs the Impact Fee adoption process and assessment. If approved, these fees would help generate revenue on new developments to fund or recoup costs of Water, Wastewater, and Roadway capital improvements attributable to the new development. The benefits of Impact Fees are:

  • lessening the impact of costs for new capital improvements on existing rates and taxpayers
  • helping pay for a percentage of projects directly related to necessary improvements due to growth, therefore offsetting debt or raising rates

The public is invited to the hearing and is welcome to provide feedback concerning the adoption of Impact Fees for water, wastewater, and roadway capital improvement and facility expansions. This public hearing is one of the many steps required by the Local Government Code to adopt Impact Fees. To study the adoption of Impact Fees a Capital Improvements Advisory Committee (CIAC) was formed in July of 2023. The Committee held their most recent meeting on January 23, 2024 and recommended to Council the assessment of the following:

  • Impact Fees for Water at ninety percent (90%) the Maximum Assessable Rate;
  • Impact Fees for Wastewater at twenty percent (20%) the Maximum Assessable Rate;
  • To accept the results of the Roadway Impact Fee Study and adopt an Impact Fee of $0 for Roadways.

Following the public hearing held during the February 1st, 2024, Council meeting no action will be taken. The Brenham City Council will consider an ordinance adopting Impact Fees during the February 15 City Council Meeting.
